TERMS AND CONDITIONS

  1. Who We Are. Canadian High Schools Model United Nations (“CAHSMUN”, “we”, “us”, and “our”) is a non-profit organization registered in British Columbia under the Societies Act. To ensure an exceptional participant experience, we want to help you understand our relationship and mutual responsibilities.

  2. Agreement. The following information (“Terms and Conditions” or the “Terms”) applies to all events we operate (each a “CAHSMUN Event” or “Event”) including without limitation, CAHSMUN, Horizons, and miniEnterprize. The Terms and Conditions apply to you as the participant (“I”, “me”, “your”, “you”, and “Participant”) in a CAHSMUN Event.

    By registering for or participating in an Event, you are expressly acknowledging that you have read and understand the Terms and agree to be bound by them. We may amend the Terms from time to time without notice.

  3. Privacy. The Terms and Conditions include and incorporate by reference our Privacy Policy, which explains the types of information collected, how we use such information, and your legal rights.

  4. Admittance. We reserve the right to, without liability, refuse admittance to or remove from a CAHSMUN Event anyone that we determine, in our sole discretion, is acting contrary to our Conference Policies, is violating the Terms and Conditions, or represents a risk to the Event.

  5. Participant Behaviour. We expect participants to treat CAHSMUN staff, venue staff, and each other with respect and conduct themselves professionally. Participants are required to follow our Participant Charter, Code of Conduct, Technology Policy, and Plagiarism Policy (together, the “Conference Policies”). The Terms and Conditions include and incorporate by reference the Conference Policies. You agree to follow all instructions provided by CAHSMUN and understand that your failure to do so may result in removal from the CAHSMUN Event without a refund.

  6. Venue Policies. The venue for each CAHSMUN Event may set additional policies on participant behaviour, including charging fees for behaviour violations and damages to the venue. All venues are smoke-free premises and charge a minimum $250 cleaning fee. You agree to allow the venue to charge fees and damages directly or reimburse CAHSMUN for any fees or damages charged to us. You further agree to follow all instructions provided by venue staff and understand that your failure to do so may result in removal from the CAHSMUN Event without a refund.

  7. Changes. We make every effort to ensure that all aspects of the CAHSMUN Event, such as the format, venue, and schedule, are accurate upon publication. However, we make no guarantees or warranties about any aspect of an Event. We may make changes to the Event at any time.

  8. Postponements and Cancellations. We may, in our sole discretion, postpone or cancel a CAHSMUN Event. If we postpone or cancel an Event, we will provide you the option between a transferable ticket for the rescheduled date or a transferable credit for a future event valid for one year from the time of issuance.

    If we postpone or cancel an Event for any reason except Force Majeure, our aggregate liability is limited to a refund of your registration fees after deducting reasonable administration costs. We will not be liable for any damages or costs you incur as a result of the postponement or cancellation.

  9. Force Majeure. We will not be responsible for any loss if the CAHSMUN Event is postponed or cancelled due to a circumstance that makes performance impossible, illegal, or commercially impracticable (“Force Majeure”). Force Majeure includes without limitation, an act of God, fire, flood, natural disaster, labour disputes, government regulations, civil disorder, war, or terrorism.

  10. Transfers. We will permit you to transfer your registration for a CAHSMUN Event to another individual from your educational institution. You must notify us by the earlier of the end of registration or 45 days before the Event. This provision does not apply if your school pays us on your behalf.

  11. Refunds. By accepting your registration for a CAHSMUN Event, we are providing you a ticket, which is a revocable license. Your ticket remains our property and we may revoke your license at any time by refunding your registration fee or exercising our rights under paragraph 4.

    If you cancel your registration, you are subject to the current refund policy published on the respective CAHSMUN Event website for CAHSMUN, Horizons, and miniEnterprize. All fees not included in the refund policy are non-refundable, unless listed otherwise.

  12. Insurance. You are solely responsible for arranging appropriate and sufficient insurance coverage in connection with your attendance at a CAHSMUN Event, including without limitation, travel insurance and emergency medical insurance.

  13. No Damages, Sole Remedy. To the fullest extent permitted by applicable law, CAHSMUN excludes:

    (a) all liability for loss, injury or damage to persons or property at the CAHSMUN Event;
    (b) all indemnities, warranties, representations, whether express or implied; and
    (c) any indirect or consequential loss however arising suffered by you.

    If we are liable to you for any reason, your sole remedy against us is a refund of your registration fees. This amount constitutes our total aggregate liability in relation to the Event.

  14. Media Release. By participating at a CAHSMUN Event, you:

    (a) authorize CAHSMUN and our representatives to photograph, film, and record your name, image, and performance (the "Media") at the Event;
    (b) grant us the right to publish or distribute the Media on our website, social media, and promotional materials; and
    (c) waive any right to approve the use of the Media now or in the future, whether the use is known to you or unknown, and waive any right to any royalties related to the use of the Media.

    Further, you understand that the Media may appear on the internet or in other publications outside of our control. You agree that you will not hold us responsible for any harm that may arise from such unauthorized reproduction.

  15. Dispute Resolution. You agree to attempt to resolve all disputes with CAHSMUN informally through our Complaint Resolution Process. If the dispute cannot be resolved within 30 days or by mutual agreement, any party may proceed with a formal dispute as set out below. Disputes will be governed by and construed in accordance with the laws of the Province of British Columbia.

    You agree to resolve all formal disputes for amounts up to $5,000 CAD through the BC Civil Resolution Tribunal. For all other formal disputes, you agree to attempt to resolve the dispute by mediated negotiation with the assistance of a neutral person appointed by the Vancouver International Arbitration Centre administered under its Mediation Rules.

    If the formal dispute cannot be settled within 30 days after the mediator has been appointed, or such other period agreed to in writing, you agree that you will resolve the dispute through binding, confidential, and final arbitration administered by the Vancouver International Arbitration Centre, pursuant to its Rules. The arbitration will be held in Vancouver, British Columbia and conducted in English. The costs of the arbitrator will be divided equally between you and us.

  16. No Class Action. You may only resolve disputes relating to or arising out of the Terms and Conditions on an individual basis. You expressly waive any right you may have to start or participate in any class action against CAHSMUN and you agree to opt out of any class proceeding against CAHSMUN.

  17. Waiver and Assignment. No agent or representative of CAHSMUN has authority to alter, modify, or waive any provisions of the Terms and Conditions. You may not assign your rights or duties under the Terms and Conditions without our prior approval.

  18. Notice. Any notice required or permitted by the Terms and Conditions must be in writing.

  19. Severability. If any provision of the Terms and Conditions is held to be invalid or unenforceable that provision will be eliminated or limited to the minimum extent possible, and the remainder of the Terms will have full force and effect.

  20. Acceptance. The Terms and Conditions constitute the entire agreement between you and CAHSMUN, supersedes all other written and oral agreements between you and CAHSMUN in relation to the CAHSMUN Event, and may not be amended except by mutual agreement.
